| 内容記述 | In recent years, issues over eugenic operations have been drawing attention, and lawsuits have been filed against the formerEugenic Protection Act across Japan. Eugenic operations are a surgical operation to deprive disabled persons of their reproductive function due to their disabilities. This operation has unilaterally been conducted by the national government without obtaining consent from disabled persons. In a ruling rendered by the Sendai District Court against plaintiffs who were the victims of the eugenic operations and claimed national compensation, while their reproductive rights were recognized as a new human right, the plaintiffs lost the lawsuit. Thus, this paper examines reproductive rights and the ruling of this case. Meanwhile, there have been frequent cases where mothers killed their newborn babies. Behind these cases, there is a situation in which sufficient reproductive rights are not guaranteed for women. Therefore, this paper also explores women’s reproductive rights. |
